Filing a tenancy agreement with IMPIC
A tenancy agreement only has to be filed with IMPIC when the monthly rent is 2 500 € or more. Below that there is no filing duty.
The 2 500 € threshold
Article 46(3) of Law 83/2017 limits the duty to contracts "whose monthly rent is equal to or above 2 500 €". The threshold is per contract and per month, not per year or per portfolio. Property transfers have no threshold at all.
What is required, and by when
- The parties: landlord and tenant, with name, tax number and ID document.
- Contract details: number, type, term, start and end dates, and the rent.
- The property: address, tax registration, land registry and DICOFRE parish code.
The deadline is the same quarterly one as for other transactions, counted from the date the contract was signed. Tenancy support in ComunicaPro is still in preparation: the XML schema covers these fields, but we will calibrate against real tenancy contracts before enabling it. Sales are fully supported.
